Do Not Sell or Share My Personal Information, and related rights under United States state privacy laws.
1.1. This notice addresses the California Consumer Privacy Act as amended by the California Privacy Rights Act, and the comparable statutes of other states of the United States.
2.1. NB Studio does not sell personal information for monetary or other valuable consideration; does not share personal information for cross-context behavioural advertising; and does not use or disclose sensitive personal information for purposes beyond the provision of the service. None of the foregoing has occurred in the preceding twelve months, including in relation to persons under 16 years of age.
2.2. Should the position stated in clause 2.1 change, this page will be amended in advance of that change and a functioning opt-out mechanism provided.
3.1. Opt-out preference signals transmitted by a browser, including the Global Privacy Control signal, are honoured. Statistics and marketing cookies remain disabled unless affirmatively enabled by the user; reference is made to the Cookie Policy.
4.1. The data subject has the right to know the categories of personal information collected, the sources from which it was obtained, the purposes of the processing and the recipients to which it has been disclosed; to obtain a copy in a portable format, account holders being able to export their own data from the management panel without application; to obtain deletion, save where retention is required by law; to obtain correction of inaccurate information; and not to be subjected to discrimination for the exercise of any such right, whether by denial of service, difference in price or reduction in the quality of the service.
4.2. The rights to opt out of selling or sharing and to limit the use of sensitive personal information do not fall to be exercised, for the reasons stated in article 2.
4.3. These rights are extended to residents of every state of the United States, irrespective of whether the state of residence has enacted a statute conferring them.
5.1. Requests are made by electronic mail to [email protected]. Receipt is acknowledged within ten business days and a substantive response is provided within forty-five days, which period may be extended once by a further forty-five days upon notice of the extension and of the reasons for it. Verification of the identity of the requesting party may be required. The creation of an account is not a condition of making a request.
5.2. An authorised agent may make a request on production of written authorisation signed by the data subject, from whom direct confirmation of the authorisation may be sought.
5.3. A determination may be appealed by reply to the same address, the appeal being determined within forty-five days by a person other than the person who made the original determination. Residents of states conferring a right of appeal may thereafter contact the Attorney General of the state of residence; residents of California may contact the California Privacy Protection Agency.
6.1. Personal information collected through the booking or ordering forms of a restaurant is controlled by that restaurant, NB Studio acting as its service provider. Requests in respect of such information are to be addressed to the restaurant; requests addressed to NB Studio are transmitted to the restaurant, which is assisted in responding. Reference is made to article 4 of the Privacy Policy.
